TikTok set to challenge its US app ban in court

US President, Biden just signed possible TikTok ban into law

In the event that Congress adopts laws authorizing a national ban on the app, TikTok intends to launch a legal battle.

A foreign aid package containing language that could result in the prohibition of TikTok was passed by the House of Representatives, and the bill may be approved by the Senate in a matter of days.

Michael Beckerman, head of public policy for TikTok in the Americas, forewarned staff members that they would file a legal challenge in the courts if President Joe Biden signs the measure.

According to the law, ByteDance, the Chinese parent company of TikTok, must sell the app within 270 days or else it would be against the law for US app shops to allow users to download TikTok.

If Biden thinks there has been movement toward a sale, he may decide to extend the deadline by an additional ninety days.

Supporters of the bill contend that it is an essential precaution to safeguard Americans’ personal data, while the social media platform has openly opposed it, citing it as a violation of the First Amendment rights of its users.

TikTok may have a case, according to some First Amendment legal experts, since courts frequently consider how a legislation would ultimately affect the freedom of speech of citizens.
